Compared to the well established screening industry in the U.S. that offers employers quality, timely and low cost, "public record" criminal searches, access to and the use of criminal records overseas is still very much in its infancy stage. This is due to the wide variations in local law. The US concept of "public records" is quite different or even nonexistent in countries abroad. Background checking by employers or any third party is now hitting the global community in full force. There are privacy, human rights, and other local legal provisions relevant in several countries that are much different than the U.S. and should be closely examined prior to undertaking any overseas criminal record request.

This session will examine various sources of legitimate overseas criminal information, discussion about national laws on criminal records, general types of permissible access, and finally questions screening companies should be asking their international providers.
